On June 13, 2024, U.S. Senators Mike Rounds (R-S.D.), Cindy Hyde-Smith (R-Miss.), and Bill Cassidy, M.D. (R-La.), the Health, Education, Labor, and Pensions Committee Ranking Member, introduced a Congressional Review Act (CRA) resolution of disapproval aimed at blocking a Biden administration rule concerning Title IX.
The proposed resolution seeks to overturn the Department of Education's final rule titled “Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance.” The revised Title IX rule redefines “sex” to include gender identity and rescinds certain due process protections for students involved in disciplinary procedures.
Critics argue that incorporating Sexual Orientation and Gender Identity (SOGI) protections into Title IX will allow biological males who identify as females to compete in women’s and girls’ sports.
“Title IX was created to protect girls and women from discrimination, not to be used for political purposes,” said Rounds. “The Biden administration’s glaring misinterpretation of this rule will harm women who have the right to a level playing field. I am proud to join my colleagues in introducing this CRA to protect the rights of women from a far-left political game.”
Hyde-Smith echoed these sentiments: “President Biden’s Title IX regulation stretches the law way beyond reason, ignores basic biological facts, and infringes on the rights of parents and teachers. It is a backward rule that only hurts women and girls by stripping away opportunities and rights they have enjoyed for decades.”
Dr. Cassidy added: “Title IX has been about making sure women have a fair shake relative to men. The new Biden rule radically overhauls Title IX, injecting a progressive gender ideology that removes longstanding protections for women and girls. This is the death of Title IX as we know it.”
